This terms and conditions generator drafts the terms of service for an information website, an online service or web app, or an online store. You enter your business details and the place whose law should govern disputes, then switch on the parts that apply: user accounts, payments or subscriptions, user-posted content and refunds. The text covers acceptance, the service, acceptable use, intellectual property, disclaimers, limitation of liability, termination, governing law, changes and contact details. Sections you switch off disappear, and the wording changes to suit the type of site.
How to use it
- Enter the business name, website address and a contact email.
- Enter the country whose law governs the terms and the city whose courts hear disputes.
- Choose what the site is: an information website, an online service or web app, or an online store.
- Tick the options that apply, such as accounts or refunds.
- Fill in every placeholder in square brackets, then copy or download the Markdown or HTML.
How to read the result
This is a starting template, not legal advice. Laws differ by country and change; have a lawyer review the text before you publish it.
With the default settings, a web app with accounts, paid plans and refunds, the terms have 12 sections and 16 placeholders. The payment section shows how much is left for you to decide: the billing period, where users cancel, the currency, whether prices include tax, the notice you give before a price change ([30 days'] in the template) and the refund window ([14 days]).
The liability cap is a placeholder for a reason. The template suggests the greater of what the customer paid in the last 12 months and USD 100. A customer on a USD 20 monthly plan who has paid for a full year could then claim up to USD 240. Some countries limit caps like this against consumers, which is why the text says "to the extent the law allows".
Switching to an online store replaces the subscription wording with orders, delivery and returns.
If the terms are for a product we are building with you, see web app development. The privacy policy generator covers the policy your terms point to.
Questions
Frequently asked.
Are terms of service and terms and conditions the same thing?
For most websites, yes. Terms of service, terms of use and terms and conditions are different names for the same kind of document: the rules for using your site or service. Pick one name and use it the same way in your footer, sign-up form and checkout so users are never unsure which text applies.
Can I publish generated terms without a lawyer?
You can, but you should not rely on them unreviewed. This is a starting template, not legal advice. Laws differ by country and change; have a lawyer review the text before you publish it, especially the refund, liability and governing law sections, because consumer law often overrides what a business writes.
How do I get users to agree to the terms?
Link to them in the footer. For sign-ups and purchases, add a short statement next to the button, such as "By creating an account you agree to our terms of service", or an unticked checkbox the user must tick. Keep a record of which version of the terms each user accepted and when.
