Outsourcing web development to India from Bahrain
A business in Bahrain can work remotely with a web development team in India. Plan calls around the time difference and agree how the project will be managed. India is on Bahrain’s list of countries with adequate personal data protection, though you still need to check your processor’s safeguards. Bahrain’s VAT reverse charge can apply to imported services, and Indian export treatment depends on conditions being met. Discuss payment, invoicing and dispute arrangements before work starts.
Checked against official sources on 5 November 2026. General information, not legal advice: confirm the rules that apply to your business with an adviser.
How can we arrange working hours across Bahrain and India?
IST is 2h30m ahead of Bahrain, where the working week is Sunday–Thursday. Agree call times with your Indian team and check when you can both respond to project questions.
Can we send personal data from Bahrain to a team in India?
India is on the list of countries with adequate personal data protection annexed to Bahrain’s Ministerial Resolution No. 42 of 2022. A Bahrain data controller can therefore transfer personal data to India without a permit from the Personal Data Protection Authority.
You still need to check safeguards. Under Bahrain’s PDPL, data controllers must use processors that give sufficient guarantees about the required technical and organisational measures, and take reasonable steps to verify compliance.
From 13 May 2027, section 17(1)(d) of India’s Digital Personal Data Protection (DPDP) Act, 2023 will apply when a person based in India processes personal data of individuals outside India under a contract with a person outside India. In that situation, most Data Fiduciary obligations, data principal rights in Chapter III and the transfer rule in section 16 will not apply. Responsibility for compliance, including by Data Processors, and reasonable security safeguards against personal data breaches will still apply.
How do VAT and Indian export rules affect the work?
For services subject to VAT in Bahrain that a VAT-registered person in Bahrain receives from a non-resident supplier, the VAT reverse charge applies by default. The customer accounts for VAT in its own return and may deduct it as input tax under the normal rules; the supplier does not need to register for VAT in Bahrain.
India treats exports of services as zero-rated supplies under section 16(1) of the Integrated Goods and Services Tax (IGST) Act, 2017. Export status depends on conditions, including the supplier being in India, the recipient and place of supply being outside India, and payment being received in convertible foreign exchange or in Indian rupees wherever permitted by the Reserve Bank of India. The supplier and recipient must also not be merely establishments of a distinct person.
What should we agree about paying an Indian supplier?
Agree payment arrangements with your supplier before work starts. Under India’s Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026, in force from 1 October 2026, an Indian exporter must realise and repatriate the full value of exported services within nine months from the invoice date, or twelve months if the export is invoiced or settled in Indian rupees. More time can be allowed by its Authorised Dealer bank on request.
What should our contract say about disputes?
Ask how disputes and arbitration would be handled in the contract. India signed the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards on 10 June 1958 and ratified it on 13 July 1960. Its declaration limits application to awards made in another contracting State and to differences considered commercial under its national law.
What should you check before outsourcing to India?
Check your language needs before briefing a team. Arabic is Bahrain’s official language, and English is widely spoken as the standard language of business and higher education.
